1. About these terms

These Terms of Use are an agreement between you and Elohimed Care Private Limited, a company registered in India under the Companies Act, 2013, with its registered office at SY No 132, Location No 8, WeWork Cinnabar Hills, Embassy Golflinks Business Park, Domlur, Bengaluru 560071, India ("we", "us", "our"). They apply when you use the Hubo One app or the website www.hubo.one (together, "Hubo One").

By creating an account or using Hubo One, you agree to these terms. Please also read our Privacy Policy, which explains how we handle your personal data. If you do not agree to these terms, please do not use Hubo One.

2. Who can use Hubo One

  • You must be 18 or older. We ask for your date of birth at sign up, and we close accounts we learn belong to someone younger.
  • We currently offer Hubo One in India. If you use it from another country, you are responsible for following the laws that apply there.
  • Your account is for you alone. Please give accurate details, keep them up to date, and do not share your account or let anyone else use it.
  • You sign in with one-time codes sent to your mobile number and email. Keep your phone and email secure, never share a code, and tell us at support@hubo.one straight away if you think someone else has used your account.

3. Wellness, not medical care

Hubo One helps you understand your sleep, recovery, activity, food, mood, habits and cycle, and suggests small changes based on your own data. Please keep these limits in mind:

  • Not medical advice. Insights, scores and suggestions are general wellness information. They do not diagnose, treat, cure or prevent any disease or condition, and they are not a substitute for a qualified medical professional. If you have a medical condition, are pregnant, or are unsure whether a change is right for you, speak to a qualified medical professional.
  • Not for emergencies. If you feel unwell or think you may be in danger, call 112 or go to the nearest hospital. Do not wait for, or rely on, anything in Hubo One.
  • Not a method of contraception. Women's monthly rhythm, including its fertility planning features, estimates where you are in your cycle. It must not be used to prevent pregnancy.
  • Data can be imperfect. Wearables, phones and the information you enter can be wrong or incomplete, and insights built on them can be too.
  • Some insights are written with artificial intelligence. We design and test how they work, but AI can make mistakes. Use your own judgement, and stop any activity that causes pain or discomfort.
  • Your choices are yours. You decide what to do with any insight, including whether to exercise, rest or change what you eat.

4. Free features and the free trial

Most of Hubo One is free to use for as long as you have an account. Some deeper features are only available on a paid plan.

Free trial. When you create your account, you automatically get 14 days of the paid features for free. No card or payment details are needed. When the 14 days end, the paid features simply switch off, and you keep using the free features. The trial never turns into a paid plan by itself, and you will not be charged unless you choose a paid plan. The trial is available once per person.

Streaks, badges and challenges. These are there to make progress more fun. They have no cash value and cannot be exchanged or transferred.

Paid plans are available monthly or yearly. You can pay in one of these ways:

  • In the Android app, through Google Play;
  • In the iPhone app, through the Apple App Store;
  • On our website, in India only, through our payment partners Razorpay and Cashfree.

The price, including any applicable taxes, is shown before you pay.

Renewal.

  • Google Play and the App Store: your plan renews automatically at the end of each month or year, at the price then in effect, until you cancel. The store handles the renewal.
  • Our website: your plan renews only if you turn on auto-renew. If you do, it renews at the end of each month or year, at the price then in effect, and you will receive a notice before each renewal payment, as Reserve Bank of India rules require. If you do not turn on auto-renew, your plan simply ends at the end of the period you paid for, and you are not charged again.

Price changes. Our current prices include a launch offer. If we change the price of your plan, we will tell you in advance, and the new price applies only from your next renewal after the notice. If you do not want to continue at the new price, you can cancel before then. Google Play and the App Store may also ask you to agree to a price increase before it applies.

We never see or store your full card, UPI or bank details. Those are handled by Google, Apple or our payment partners, under their own terms.

6. Cancelling and refunds

How to cancel

  • Google Play: in the Play Store app, open Payments and subscriptions, then cancel Hubo One.
  • App Store: in your iPhone's Settings, tap your name, then Subscriptions, then cancel Hubo One.
  • Website: if you turned on auto-renew, email support@hubo.one from the email address on your account and we will turn it off. If you did not, there is nothing to cancel; your plan ends by itself.

Cancelling stops the next renewal. You keep the paid features until the end of the period you have paid for. Deleting your Hubo One account does not cancel a plan paid through Google Play or the App Store, so please cancel there first.

Refunds for plans paid on our website

  • Monthly plans: no refunds. You can cancel at any time, and access continues to the end of the month you paid for.
  • Yearly plans: a full refund if you ask within 7 days of your first yearly payment. After that, yearly plans are not refundable, but you can cancel so they do not renew.
  • Mistakes: if you are charged twice or charged in error, we refund the extra amount in full.

To ask for a refund, email support@hubo.one from the email address on your account. Approved refunds go back to your original payment method within 7 working days of approval; your bank may take a little longer to show it.

Refunds for plans paid through Google Play or the App Store

Google and Apple process these payments, so their refund rules apply and refund requests go to them. We cannot issue refunds for store payments ourselves.

Nothing in this section limits any right to a refund you have under Indian consumer law.

7. Your content

Your content means the things you add to Hubo One, such as journal entries, food logs, photos, voice recordings, messages and the records you keep in Unified Records. Your content belongs to you.

You give us permission to store, process and display your content only as needed to run Hubo One for you and to keep it safe, as described in our Privacy Policy. This permission ends when your content is deleted.

Please only add content you have the right to add, and do not upload anything unlawful, or anything belonging to someone else without their permission. Records you keep in Unified Records come from their original sources, and we do not check them for accuracy.

8. Connected apps and devices

You can connect Hubo One to Apple Health, Health Connect, wearables and India's Ayushman Bharat Digital Mission. These services are run by other companies and organisations under their own terms and privacy policies. We are not responsible for their availability, their accuracy, or changes they make that affect what Hubo One can read.

9. Using Hubo One fairly

When you use Hubo One, please do not:

  • break the law, or use Hubo One to harm, harass or deceive anyone;
  • use another person's account, or create accounts in someone else's name;
  • copy, resell or rent out Hubo One or its content, or use it to build a competing product;
  • reverse engineer, decompile or try to extract the source code of the app, except where the law allows it;
  • use bots or automated tools to access Hubo One, or collect data from it;
  • try to get around security features, access systems or data you are not allowed to, or interfere with how Hubo One works;
  • upload viruses or harmful code;
  • try to make the AI features produce harmful or unlawful content.

10. Our name and our work

Hubo One, its logo, design, software, text, insights library and all other content we create belong to Elohimed Care Private Limited or the companies that license them to us, and are protected by intellectual property laws. We give you a personal, limited, non-transferable right to use Hubo One for yourself, under these terms. Please do not use our name or logo without our written permission.

If you send us ideas or feedback, we may use them to improve Hubo One without owing you anything for them.

11. Changes to Hubo One

We keep improving Hubo One, so features will change over time. App updates may be needed to keep using it. If we remove a paid feature in a way that significantly reduces what you paid for, we will tell you in advance, and you can cancel. If we stop offering paid plans altogether, we will refund the unused part of any plan you paid for on our website.

12. Deleting or suspending an account

You can delete your account at any time from the menu in the app. We keep your data for 7 days in case you change your mind; email privacy@hubo.one within 6 days to cancel the deletion. By the end of the 7th day, your data is permanently deleted and cannot be recovered. See how account deletion works.

We may suspend or close an account if it breaks these terms or the law, puts other people or Hubo One at risk, or if the law requires us to. Where we reasonably can, we will tell you why first and give you a chance to fix the problem. If we close your account when you have not broken these terms, we will refund the unused part of any plan you paid for on our website.

13. Responsibility and liability

We work hard to keep Hubo One accurate, available and secure, but we cannot promise it will always be error free or uninterrupted. Hubo One is provided as it is and as available, to the extent the law allows.

To the extent the law allows:

  • we are not responsible for decisions you make, or actions you take, based on insights or other content in Hubo One (see section 3);
  • we are not responsible for losses that were not reasonably foreseeable, or for loss of profits, business or opportunity;
  • our total responsibility to you for any claim related to Hubo One is limited to the amount you paid us in the 12 months before the claim arose.

None of this limits any responsibility that cannot be limited under Indian law, including for fraud or for our own negligence causing death or personal injury, or your rights under the Consumer Protection Act, 2019 and the Digital Personal Data Protection Act, 2023.

If you break these terms or the law and that causes a claim against us by someone else, you agree to cover the reasonable losses and costs that result.

14. Google Play and the App Store

If you downloaded Hubo One from Google Play or the Apple App Store, that store's terms also apply to you. If you use the iPhone app:

  • these terms are between you and us, not Apple, and we, not Apple, are responsible for Hubo One and its content;
  • Apple has no obligation to provide maintenance or support for Hubo One;
  • if Hubo One fails to meet any warranty that applies, you can tell Apple, and Apple may refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for Hubo One;
  • we, not Apple, are responsible for handling any claims about Hubo One, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that it infringes someone else's intellectual property;
  • you confirm that you are not located in a country subject to a United States government embargo, and that you are not on any United States government list of prohibited or restricted parties;
  • Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.

15. Changes to these terms

We may update these terms as Hubo One and the law change. The date at the top shows when they last changed. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using Hubo One after a change takes effect, the updated terms apply. If you do not agree with a change, you can cancel your plan and delete your account.

16. Law and complaints

These terms are governed by the laws of India. The courts of Bengaluru, Karnataka have jurisdiction over any dispute, without affecting any right you have to bring a complaint before a consumer commission under the Consumer Protection Act, 2019.

If something goes wrong, please contact us first so we can try to put it right. You can also write to our Grievance Officer:
